However, neither Harry nor his family (wife Megan and children Archie and Lili) will return to the UK without proper police protection.
When Harry and Meghan retired from royal duties in January 2020, they lost their taxpayer-funded police protection. Since then, Harry and Meghan have been told that their security in the U.S. would be privately funded and then told that their security in the U.K. would not be privately funded, according to PEOPLE.
Harry sought judicial review of the Home Office's decision that prevented him from using his private funds to cover police protection for himself and his family while in the UK, and a preliminary hearing was held yesterday to reinstate the protection. Harry himself did not attend, but his attorney, Shaheed Fatima, expressed concern.
"This claim is about the fact that Harry does not feel safe in the UK given the security arrangements that will apply to him in June 2021 and will also apply if he decides to return to the UK," Fatima's lawyer told the Royal Court, The Guardian The Guardian reports. And, of course, his desire to return to see his family and friends and to continue supporting the charities that are his spiritual home. Above all, this is his home and will continue to be so."
The June 2021 instance to which Fatima refers is when Harry returned to the UK to unveil a statue of his late mother, Princess Diana, in the gardens of Kensington Palace on her 60th birthday on July 1. During this visit, Harry's car was chased around London by photographers, who reportedly had flashbacks to his mother's death in August 1997; by September 2021, Harry had applied for a judicial review (a legal challenge to the legality of a decision made by a public body) of the security arrangements, PEOPLE PEOPLE explains. Yesterday's hearing was an early step in this process, which could lead to longer court proceedings.
"The Duke and Duchess of Sussex personally fund a private security team for their family, but that security cannot replicate the police protection they need while in the UK," a statement previously released by Harry's legal spokesman said. In the absence of such protection, Prince Harry and his family will not be able to return to their home."
The statement went on to say that Harry had initially offered to personally pay for the cost of British police protection for Harry and his family as of January 2020, but that offer was rejected.
"The United Kingdom will always be Prince Harry's home and a country where he wants his wife and children to be safe," the statement continued."
"The lack of police protection is too great a personal risk.
According to PEOPLE, only the Queen, Prince Charles, Camilla, the Duchess of Cornwall, Prince William, and Kate Middleton currently enjoy 24-hour police protection. Other active royalty (such as Princess Anne, Prince Edward, and Sophie, Countess of Wessex) receive state protection only when carrying out official royal functions. Princesses Beatrice and Eugenie received no government-funded protection at all, and their father Andrew lost his own right to protection when he stepped down from his royal duties in November 2019.
